December 6, 2004
Commissioners
Judy A. Stang, James S. Warnken, and B. J. McComb met in a regularly scheduled
session. The commissioners conducted the following business:
- RC&D MEETING: The commissioners attended the monthly
RC&D. The main agenda item was a presentation on the water rights
dilemma in the State of Montana and the highlights of the Clark Fork River
Basin Water management Plan and its recommendations. For complete minutes
contact the Mineral County Extension Office.
- MISSOULA JOB SERVICE: Will Stubsten and Gary Swartz, Missoula Job
Service, checked in with the commissioners to update them on the job
service programs working in Mineral County. Currently they are working
with a new day care center in St. Regis to enroll one of the new employees
in On the Job Training program. Other than that they are checking in with
business and also the Hospital to see if any of there services are needed.

December 7, 2004
Commissioners Judy A. Stang, James S. Warnken, and B. J. McComb met in
a regularly scheduled session. The commissioners conducted the following
business:
- CONNOLLY MAJOR SUBDIVISION: Present Tim Read, Mineral County Planner. Tim
presented the commissioners with a proposal from the developers of the
Proposed Connolly Major Subdivision on Payment in Lieu of Taxes. The
developers proposed subtracting the labor and costs with removing junk
cars and other debris from the property. Commissioner Warnken and McComb
would like to see receipts and do not want to subtract labor costs. The
commissioners directed Tim to call or send a written response to the
Connollys with the concerns of the commission expressed.

December 15, 2004
Commissioners Judy A. Stang, James S. Warnken, and B. J. McComb met in
a regularly scheduled session. The commissioners conducted the following
business:
- WEST MOUNTAIN ESTATES/REGUEST FOR EXTENTION: Present at the
Meeting:
- Tim Read, Mineral County Planner
- Keri Noonan-Willhite, Real
Estate Agent
- Lee Johnson, Retired
- Scott Hurst-Developer
- Dave Turner, Developer
- Kirby Christian, Attorney
- Deborah Johnston
The commissioners have
received no written comments; there were no public comments. Tim did comment
that the request for a 1-year extension met the criteria of our old subdivision
regulations and that is what this subdivision is under. Commissioner Warnken
made a motion to grant the extension, commissioner McComb seconded, the motion
passed unanimously to grant an extension to February of 2005.
- CARAMUS MINOR SUBDIVISION: Present Miriam Caramus, Developer and Tim
Read, Planner. The commissioners approved the planning boards
recommendation and gave preliminary approval to the Caramus Minor
Subdivision. There was some discussion about the access that will be used.
Shaun Donovan, Mineral County Attorney feels if the title company insures
the access that should be okay. The commissioners agreed.
- CONNOLLY MAJOR SUBDIVISION: Present Joe Connolly, Developer and Tim Read,
Planner. The commissioners granted preliminary approval to the Connolly
Major Subdivision. The commissioners agreed to revise the payment in lieu
of parks to $3,454. This amount will be due upon final plat approval.
- RESOLUTION 12-15-04A- Present Tim Read, Planner, A resolution adopting
the amended subdivision regulations for Mineral County and the towns of
Alberton and Superior amended 2004. Motion made to pass by Commissioner
McComb, Seconded by Warnken, passed unanimously. These new regulations
will be effective immediately.
- RESOLUTION 12-15-04C-A resolution adopting criteria for local
determination of evasion of the Subdivision and Platting Act. Motion to
pass by commissioner Warnken, seconded by McComb motion passed unanimously.
- RESOLUTION 12-15-04B-Present George Gupton, DES Coordinator. A resolution establishing a Pre-
Disaster hazard Mitigation Plan for Mineral County. Motion to adopt by
Commissioner Warnken, seconded by Commissioners McComb, motion passed
unanimously.
- WEST-END FIRE DISTRICT BOARD MEMBER RESIGNATION: The commissioners
received the resignation of Christine West from trustee of the West-end
Volunteer Fire District Board of Trustees.
- REAL PROPERTY CHANGES- DEPARTMENT OF REVENUE: Present Anthony
Francesco. The commissioner approved the following changes:
- Robert Dailey, A reduction of real property taxable value, due to
Department had taxed some sheds to this property and they were on another
lot.
- Tim and Patsy Skinner. An addition to the taxable value, the
Department added sheds and buildings from neighboring lot.
- Clark Fork Valley Women In Timber: reduction from tax roll, they
were granted exempt status, application #5400504
- JUSTICE OF THE PIECE CLERK STATUS: Wanda James, Mineral
County JP, was in to update the commissioners on the moneys that she has
from restitution, fines, and bonds that was not earmarked and must be
distributed. We are planning to update her employee to full time. The
money to be received will be around $12,000. It will be a non-anticipated
amount to her budget.

RESOLUTION TO
ESTABLISH MILEAGE RATE FOR CALENDAR YEAR 2005 FOR MINERAL COUNTY EMPLOYEES
WHEREAS
according to MCA 2-18-503 local government employees are to be reimbursed
mileage at the current rate set by the Internal Revenue Service, and
WHEREAS
the Internal Revenue Service has established the standard mileage rate at 40.5
cents a mile for business use of a vehicle in calendar year 2005, and
WHEREAS
under Montana law, mileage may be reimbursed at 40.5 cents for the first 1,000
miles per month traveled, and at 37.5 cents thereafter in the same month, and
SO
THEREFORE BE RESOLVED, the Mineral County Board of Commissioners adopt the
current mileage rate set by the Internal Revenue Service, and
BE
IT FURTHER RESOLVED these mileage rates become effective on January 1, 2005.

Commissioners James S.
Warnken, B. J. McComb, and Judy A. Stang met in a regularly scheduled session.
The commissioners conducted the following business:
- MINERAL COUNTY STUDY COMMISSIONERS: Present Pam Reed,
Mike Byrnes, and Dennis Hildebrand, which are the members elected to the
Mineral County Study Commission. The members came in to give the
commissioners an overview of the workshop they attended for study
commissioners elected from cities and counties at Bozeman.
- JUSTICE COURT: Present Wanda James, Mineral County JP. Wanda
was in with a letter from the State Office of the Court Administrator that
verifies an amount of $12,000, that was found when the court
administrators office balanced justice court. The monies will have to be
put into the General Fund. Previously Wanda had requested her employee be
fulltime and this money be a means to pay for it, since it was in the
middle of a budget year. The auditors and the clerk needed to see this verification. Wanda
also requested moving her office to a larger office in the courthouse;
currently the office she wants has the misdeamer Justice court and the
adult probation officer. They could go to her present office. The
commissioners approved that Wanda could move her JP receiving office to
the larger office. The commissioners will have the custodian re-design the
doorway so clients cannot enter the JP work area.
- VISTOR INFORMATION CENTER REPORT: Present Glen Keopke,
Community club Board. Glen came in and gave the commissioners an update on
the Visitor Information Center in St. Regis. The president of the
community club, Jeff Noonan, is researching the creation of the VIC board
to see if there can be a problem with its structure. The commissioners
noted that the original proposal for the structure to be in charge of the
VIC was granted to the St. Regis Community Center.

Commissioners James S.
Warnken, B. J. McComb, and Judy A. Stang met in a regularly scheduled session.
The commissioners conducted the following business:
- WANDA JAMES, JUSTICE COURT: Present Wanda James, Mineral County JP,
was in to update the commissioners on the relocation of her office to a
larger office in the courthouse. She would like to have the office that
the Department of Revenue has, they had indicated they would like to move.
The commissioners feel they are a service to our constituents and should
be conveniently located near other related government services.
Commissioner Warnken noted if they moved we really need a larger office
for our Planning and Sanitation Department.
- JASON MCCLEES, ROAD REPORT: Present Jason McClees, Road Foreman, Jason
reported they have been painting the shop and hauling scrap iron while
they have had extra time. We have had no snow to plow, which usually takes
up time this time of year.
- CLYDE MINOR SUBDIVISION: Present Bob Clyde, Developer and Tim Reed,
Planner. The commissioners signed the final plat of the Clyde Minor
Subdivision. All conditions have been met.
- AIRPORT BOARD: the commissioners received the resignation of Roger Billadeau.
The commissioners appointed Ernest Hunton.
- AIRPORT MASTER PLAN: Present Ernst Hunton, Airport Board Member.
The commissioners asked Ernst to have the airport board bring the
commissioners a draft of a Master Plan for use and future development at
the Mineral County Airport. Ernst will also purchase some kind of locks
that pilots can use and also some stakes to identify where the runway and
lights are for snowplow purposes.
- WEST-END FIRE DEPARTMENT BOARD MEMBERS: The commissioners
received the resignation of Brooke Lincoln from the West-end Rural fire
Department. The commissioners appointed Tyler Goss to fill the duration of
Brook Lincoln’s term. The commissioners appointed Roger Stevens to fill
the duration of Chris West’s term.
- MINERAL COUNTY WEED BOARD MEMBERS: the commissioners
re-appointed Ron Schlader and Jim Lommen to the Mineral County Weed Board.
